Conforme al artículo 41 fracción III de la Ley de los Institutos Nacionales de Salud los Proyectos de investigación financiados con recursos de terceros deberán sujetarse a los lieamientos generales que al respecto establezca cada Instituto Nacional de Salud; Que conforme al artículo 6 de la Ley de los Institutos Nacionales de Salud una de las funciones del Instituto Nacional de Ciencias Médicas y Nutrición Salvador Zubirán es la de realizar estudios e investigaciones clínicas, epidemiológicas, experimentales, de desarrollo tecnológico y básicas, en las áreas biomédicas y sociomédicas en el campo de las Ciencias Médicas y la Nutrición, para la comprensión, prevención, diagnóstico y tratamiento de las enfermedades, y rehabilitación de los afectados, así como para promover medidas de salud; y formar recursos humanos en sus áreas de especialización así como en aquellas que le sean afines; Que conforme al artículo 16 fracción VII de la Ley de los Institutos Nacionales de Salud, corresponde a la Junta de Gobierno de cada Instituto Nacional de Salud, determinar las reglas y los porcentajes conforme a los cuales las servidoras y los servidores públicos que participe en proyectos determinados de investigación podrá beneficiarse de los recursos generados por el proyecto, así como, por un periodo determinado, en las regalías que resulten de aplicar o explotar derechos de propiedad industrial o intelectual, que deriven de proyectos realizados en el Instituto; Que conforme a lo dispuesto por los artículos 37, 38 y 41, fracciones IV y V, de la Ley de los Institutos Nacionales de Salud, la investigación que lleve a cabo el Instituto, deberá ser básica y aplicada y tener como propósito, contribuir al avance del conocimiento científico, así como a la satisfacción de las necesidades de salud del país, mediante el desarrollo científico y tecnológico, en áreas biomédicas, clínicas, sociomédicas y epidemiológicas. En la elaboración de su programa de investigación, el Instituto deberá tomar en cuenta los lineamientos programáticos y presupuestales que al efecto establezca el Ejecutivo Federal en estas materias. Dicha investigación puede llevarse a cabo con recursos de terceros, los que en ningún caso formarán parte del patrimonio del Instituto, y sólo estarán bajo la administración del Instituto para el fin convenido; recursos que pueden ser gestionados por los propios investigadores y cuyos proyectos de investigación pueden ser presentados para su aprobación ante el Instituto en cualquier tiempo; Que la Investigación que realiza el Instituto Nacional de Ciencias Médicas y Nutrición Salvador Zubirán puede financiarse a través de recursos de terceros.

Pursuant to Article 41, Section III of the National Institutes of Health Law, research projects funded with third-party resources must adhere to the general guidelines established by each National Institute of Health; That pursuant to Article 6 of the National Institutes of Health Law, one of the functions of the Salvador Zubirán National Institute of Medical Sciences and Nutrition is to conduct clinical, epidemiological, experimental, technological development, and basic studies and research in the biomedical and sociomedical fields of Medical Sciences and Nutrition, for the understanding, prevention, diagnosis, and treatment of diseases, and the rehabilitation of those affected, as well as to promote health measures; and to train human resources in its areas of specialization as well as in related areas; That pursuant to Article 16, Section VII of the National Institutes of Health Law, the Governing Board of each National Institute of Health is responsible for determining the rules and percentages under which public servants participating in specific research projects may benefit from the resources generated by the project, as well as, for a specified period, from royalties resulting from the application or exploitation of industrial or intellectual property rights derived from projects carried out at the Institute; That pursuant to the provisions of Articles 37, 38, and 41, Sections IV and V, of the National Institutes of Health Law, the research carried out by the Institute must be basic and applied and have the purpose of contributing to the advancement of scientific knowledge, as well as to the satisfaction of the country's health needs, through scientific and technological velopment in biomedical, clinical, sociomedical, and epidemiological areas. In developing its research program, the Institute must take into account the programmatic and budgetary guidelines established by the Federal Executive Branch in these matters. Such research may be carried out with third-party resources, which in no case will be part of the Institute's assets and will be administered solely by the Institute for the agreed purpose. These resources may be managed by the researchers themselves, and their research projects may be submitted to the Institute for approval at any time.
