La fracción XXI del artículo 35 de la Ley Orgánica de la Administración Pública Federal señala que a la Secretaría de Agricultura y Desarrollo Rural, le corresponde fomentar la actividad pesquera, a través de una entidad pública, siendo ésta la Comisión Nacional de Acuacultura y Pesca (CONAPESCA), creada por lo que Decreto publicado el 5 de junio de 2001, en el Diario Oficial de la Federación. En el Reglamento Interior de la entonces Secretaría de Agricultura, Ganadería, Desarrollo Rural, Pesca y Alimentación, publicado en el DOF el 25 de abril de 2001 (SAGARPA), ahora Secretaría de Agricultura y Desarrollo Rural (AGRICULTURA) están previstas atribuciones para las Unidades Administrativas de la CONAPESCA, las cuales siguen siendo aplicables por disposición del octavo transitorio del Reglamento Interior vigente de la AGRICULTURA, entre otros, los artículo 37 al 42, hasta que se emita el propio Reglamento Interior de la CONAPESCA; la emisión del Reglamento dará mayor certeza jurídica a la actuación de las personas servidoras publicas de la CONAPESCA con los personas. Es de destacar, que no se crean nuevas plazas de trabajo o unidades administrativas a las ya existentes.

Section XXI of Article 35 of the Organic Law of the Federal Public Administration establishes that the Ministry of Agriculture and Rural Development is responsible for promoting fishing activity through a public entity, the National Aquaculture and Fisheries Commission (CONAPESCA), created by Decree published on June 5, 2001, in the Official Gazette of the Federation. The Internal Regulations of the former Ministry of Agriculture, Livestock, Rural Development, Fisheries, and Food, published in the Official Gazette of the Federation on April 25, 2001 (SAGARPA), now the Ministry of Agriculture and Rural Development (AGRICULTURE), establish powers for the Administrative Units of CONAPESCA. These powers remain applicable by provision of the eighth transitory provision of the current Internal Regulations of AGRICULTURE, including articles 37 to 42, until the Internal Regulations of CONAPESCA are issued. The issuance of the Regulations will provide greater legal certainty to the conduct of CONAPESCA public servants with respect to individuals. It is noteworthy that no new positions or administrative units will be created in addition to existing ones.
