The purpose of this DECREE is to establish the “Distrito de Riego 114 Presa Santa María, Sinaloa” (Irrigation District 114 Santa María Dam, Sinaloa, in spanish), made up of areas of the municipalities of Rosario and Escuinapa, in the state of Sinaloa, with a physical area of 48,114.60 hectares and an irrigable area of 24,250.00 hectares, which may be merged, interconnected or split in accordance with the provisions of article 75 sections I and II of the “Ley de Aguas Nacionales” (National Water Law of Mexico), and in accordance with the average annual availability of national waters, in accordance with the provisions of article 22 second and last paragraphs of the aforementioned Law and other applicable legal provisions.
This Decree defines the coordinates associated with its surrounding perimeter and is illustrated in the official plan number 01-DR114-PN-GDR-SGIH-2024_G, dated March 2024. Likewise, the purposes of the establishment of irrigation district are presented, which include: Managing, operating, guarding, maintaining and conserving, in a sustainable manner, the waters available within its perimeter, through capture, extraction, control, diversion, conduction, distribution and drainage infrastructure and the complementary actions that are necessary to maintain and increase the agricultural productivity of water and land, as well as for its sustainable management, through community management and administration of water and irrigation infrastructure establishment, all in favor and benefit of agricultural producers in the state of Sinaloa, as well as the self-sufficiency and food sovereignty of the Mexican population.
The Decree considers the water of the Baluarte River as source of supply, stored through the Santa María Dam, with a total annual volumetric availability of 401.072 million cubic meters, of which for the irrigation of the 24,250.00 hectares there is an annual volume to be granted for irrigation purposes of 338.000 million cubic meters (Mm3), which includes the volume to be granted to the “Asociación de Usuarios Productores Agrícolas del Canal Chilillos, Río Baluarte, A.C.” (Agricultural producer users of Chilillos canal, Baluarte River, Civil Association) and, therefore, the remaining volume must be granted based on the evolution of the irrigable surface that is incorporated into the operation and production. In this way, the annual volume of water extraction from the sources for the irrigation of this surface is subject to the availability that the “Comisión Nacional del Agua” (National Water Commission of Mexico) determines hydrologically and climatologically at the beginning of each agricultural cycle or year; Based on this volumetric availability, the allocation of 63.072 million cubic meters is identified to satisfy the requirements of the population of the Municipalities of Rosario and Escuinapa, Sinaloa.
Additionally, the respect for the concession rights previously existing at the time of the issuance of the decree is mentioned, to exploit, use or take advantage of national waters for agricultural purposes of civil associations of users of the irrigation district, as well as those of individuals, corporations, small landowners, ejidos, communities, irrigation units and companies holding concessions that are located inside the area of the irrigation district and that choose not to register as user of it.
