The Additional Protocol to the Framework Agreement of the Pacific Alliance, signed in Cartagena de Indias, D.T. and C., Republic of Colombia on February 10, 2014 (Additional Protocol), entered into force on May 1, 2016. On the other hand, the International Convention on the Harmonized Commodity Description and Coding System (Harmonized System), which countries from Pacific Alliance are parties, establishes a common nomenclature to expedite customs procedures and facilitate the international trade. On June 27, 2014, the World Customs Organization adopted the Sixth Amendment to the Harmonized System which includes modifications that affect directly in Annex 4.2 (Specific Origin Requirements) of Additional Protocol, therefore, the Committee of Rules of Origin, Procedures related to Origin, Trade Facilitation and Customs Cooperation adapted such Annex to the Sixth Amendment. In this regard, on January 25, 2022 the Free Trade Commision of the Additional Protocol to the Framework Agreement of the Pacific Alliance, in accordance with articles 16.2.2(a)(ii) and 4.30.2(b)(i) of the Additional Protocol, adopted the Decision 13 regarding the update of Annex 4.2 (Specific Origin Requirements) to 2017 Harmonized System and its Annex. In this regard, this Agreement aims at informing to individuals and customs authorities the Decision 13 and its Annex, which do not provide for obligations or costs for individuals.
